Appeals court tosses kids’ challenge to Trump energy orders
An appeals court threw out a lawsuit brought by 22 young people that challenged President Trump’s executive orders setting federal energy policy, ruling on Tuesday that federal judges have no power to grant their request.
The U.S. Court of Appeals for the 9th Circuit panel ruled the children and young adults have no right to sue over claims the policies are endangering their health and the climate.
“Issuing such an injunction would effectively place one federal district court in charge of executive branch energy policy,” the group wrote.
The panel is comprised of U.S. Circuit Judge Lawrence VanDyke, a Trump appointee; U.S. Circuit Judge Jennifer Sung, an appointee of former President Biden; and U.S. Circuit Judge John Owens, an appointee of former President Obama.
