Senate passes 10-day extension of nation’s spy powers

The Senate on Friday passed a 10-day extension of the nation’s warrantless spy powers, approving a House plan hatched on the floor after a chaotic rejection of a package negotiated with skeptics.

The bill will now head to the president’s desk, but Section 702 of the Foreign Intelligence Surveillance Act (FISA) will continue to dominate Congress in the days ahead.

The government’s ability to spy on foreigners located abroad will now expire April 30 instead of Monday, but critics are still pushing for protections for Americans whose data gets swept up if they communicate with targets under surveillance.

President Trump has publicly called for an 18-month extension to FISA’s Section 702 without any reforms to the program.

But that call has still sparked pushback within the party’s right wing.

After punting several votes and hours of back-door negotiations, the House failed to pass the deal made between leadership and members of the House Freedom Caucus. However, some involved in brokering that agreement failed to back it, as did several members of the House Intelligence Committee who support a clean extension.

There’s no clear path forward over the next few days.

The dynamic in the House remains largely unchanged, though Democrats there have said the failure on the floor shows Republicans need to work with them. Many on the left side of the aisle also want to see reforms.

Privacy-minded lawmakers in the Senate have made similar comments, with Sen. Ron Wyden (D-Ore.) saying he also wants changes as part of a longer passage.
