President Trump is facing pushback from Republicans over his administration’s decision to strip temporary protected status (TPS) from Haitian migrants living in the U.S. following the Supreme Court’s decision last month to uphold the policy. 

Ohio Gov. Mike DeWine (R) urged Trump to “reconsider” the policy late last month, while Rep. Carlos Gimenez (R-Fla.) warned deporting Haitians back to their native country would be “a huge mistake.” Rep. Mike Lawler (R-N.Y.) has said he never disputed Trump’s ability to end the program but warned that the Supreme Court’s decision to end protections for Haitians could create a crisis.

The warnings risk creating a rift between the president and some of his allies on the administration’s hard-line immigration stance. 

In Mullin v. Doe, the high court ruled in a 6-3 decision along ideological lines that the Trump administration possesses the authority to cut off temporary legal protections for thousands of foreign nationals who are unable to safely return to their countries of origin due to extreme conditions like armed conflict and natural disasters. 

The decision directly impacts foreign nationals from Haiti and Syria but could set a precedent that threatens more than one million TPS holders from 11 other countries for whom the Trump administration has pushed to rescind the protections, including Venezuela, Afghanistan and Somalia. Their lawsuits remain ongoing, but immigration advocates have warned the decision signals “bad news” for every TPS recipient.

“The White House must recognize a reality: we cannot deport hundreds of thousands of people from the country overnight,” Rep. Maria Elvira Salazar (R-Fla.) said in a social media post on Monday.
