The murder trial for Damian Hudson, the man charged with fatally shooting Karolina Huebner-Makurat in front of a Toronto injection site on July 7, 2023, appeared at its outset to be the criminal justice equivalent of a foregone conclusion.

Hudson conceded in an agreed statement of facts early in the trial that he was at the injection site that day because he was a drug dealer and had fired the bullet that caused a much-loved and respected mother of two young girls to bleed to death on one of the busiest streets in the city.

Further, the entire incident had been captured by the ubiquitous recorders of modern life — security cameras, dashcams and smart phones. Well, not quite the entire incident.

About three seconds of the chaos that unfolded after Hudson was ambushed and robbed by two other drug dealers in front of the South Riverdale Community Health Centre’s injection site in east Toronto were obscured by a tree and the concrete planter that housed it on the sidewalk as Hudson fell to the ground and fired the fateful shots as he returned to his feet.

These two heartbeats in time were all that Hudson’s lawyer, Charn Gill, needed to draw the curtains wide open on the prospect of reasonable doubt. Did Hudson bring his own gun to the injection site that day or did he pick up a gun dropped by his younger assailant, Ahmed Ibrahim, also a drug dealer, as Hudson struggled to reclaim his satchel containing thousands of dollars’ worth of drugs and cash, firing it at Ibrahim’s accomplice, Ahmed........
