A neighbor's tree hangs over their carport. How can they protect their property?

Most companies that trim trees will want to have their workers climb the tree, and that means they may need to enter your neighbor's yard.

Q: Our next-door neighbor’s 40-foot-tall tree encroaches over our carport. Each fall, it makes a mess of the carport and yard. We are also concerned that the tree will hit our roof during a tropical storm or hurricane (we live close to Galveston Bay). We have asked numerous times for him to cut it down, but so far nothing has happened. One of his back yard trees fell on our roof 17 years ago. We paid to remove the tree. Even though we asked him to pay us back, he never did. What should we do?

A: It seems clear that your neighbor is not going to do anything you ask him to do.
