Rep. Anna Paulina Luna (R-Fla.) filed two resolutions on Wednesday that would censure Rep. Tony Gonzales (R-Texas) or strip him of his committee assignments.

Gonzales has come under increasing scrutiny in recent months over allegations that he had an affair with one of his congressional staffers, who died after setting herself on fire. The House Ethics Committee announced Wednesday that it had opened an investigation into Gonzales.

One of Luna’s resolutions, calling for a censure of Gonzales, alleges that he “failed to meet even the minimum standards of ethical conduct by having an affair with a member of his staff,” according to a copy obtained by The Hill.

The San Antonio Express-News last month reported that the staffer, Regina Ann Santos-Aviles, wrote to another staffer in April: “I had an affair with our boss and I’m fine.” Text messages said to be extracted from Santos-Aviles’s phone provided by her widower to media outlets, including The Hill, appear to show Gonzales soliciting sexual material from Santos-Aviles as she said he was going too far.

Gonzales has called the allegations political smears pushed by his political opponents. 

“We can’t have people out here molesting their staff,” Luna said. “That’s not acceptable…It’s just like really, really unfortunate that it’s come to this.”

Luna’s other resolution calls for Gonzales to be removed from the House Homeland Security Committee and the House Appropriations Committee.

Luna told The Hill she’s still deliberating on the timing of when she will force a vote on the resolutions.

She had previously called for Gonzales to withdraw his reelection bid. After Tuesday’s tight primary election, Gonzales will head into a May runoff against gun rights YouTuber Brandon Herrera.

Speaker Mike Johnson (R-La.) told reporters on Wednesday that he’s waiting to see how the Ethics Committee investigation will play out.

“The voters have spoken last night,” Johnson said, adding: “I’ve always been consistent. We allow due process and investigations to play out. So we’ll see what happens.”
