Overcoming obstacles for diminished value claim on leased car
A diminished value claim after an accident is tricky because you don't own the vehicle, the leasing company does.
Q: My leased car had only 900 miles on it when it suffered damage in excess of $13,000 in an accident that was the other driver’s fault. His insurance company paid for the repairs but has refused my diminished value claim. They said that this type of claim can only be filed by the leasing company at the end of the lease. When the same thing happened to me a few years ago, the leasing company authorized me to file a claim. The insurance proceeds were paid to them, and then they deposited the money into my lease account. Is there a Texas insurance law that governs how these situations are handled?
