Homeland Security And The Politics Of Conditional Citizenship: The Ilhan Omar Investigation – OpEd
Federal agents executed a judicially authorized search of Rep. Ilhan Omar’s residence on October 12, seized her phone, and issued grand-jury subpoenas as part of a multiyear probe that reporting indicates seeks to examine her naturalization and potentially revoke her citizenship, with no charges announced.
The search occurred 22 days before midterm elections in which Omar is running, raising questions about the informal 60-day norm against overt investigative steps, while prior public statements by senior officials about investigating her immigration status have intensified concerns over selective enforcement and political influence.
Denaturalization requires clear and convincing proof that citizenship was unlawfully procured, and any proceeding against a sitting member would raise unresolved constitutional questions about the House’s exclusive power to judge qualifications, with the case now watched as a test of whether security institutions are insulated from partisan use.
Few tests of a constitutional democracy are more revealing than how its security institutions treat an elected opponent of the government in power. Over four days in mid-October, the United States has placed itself squarely inside that test.
The Justice Department said Homeland Security Investigations executed a judicially authorized search warrant in the Washington area as part of an ongoing federal criminal investigation, targeting the residence of Rep. Ilhan Omar of Minnesota on Oct. 12. Omar described the search as “an attempt to target political enemies and weaponize federal law enforcement.” Within days the inquiry widened. Federal authorities seized her phone and issued more than a dozen grand jury subpoenas, including to some of her relatives, according to a person briefed on the probe. The Wall Street Journal reported that the investigation is aimed at building a case to revoke her U.S. citizenship and deport her, with investigators examining how she obtained citizenship after arriving from Somalia, including actions taken by her late father. Separately, U.S. Attorney Jeanine Pirro said several investigations are underway and that her office is also examining the lawmaker’s financial disclosures. Immigration Agents Raid Rep. These are serious developments. They are also, at this stage, allegations and reported objectives rather than established facts. The analytical task is to separate what the record shows from what it does not, and to ask what the episode reveals about the relationship between security power and political opposition in the world’s most influential democracy.
What the record shows, and what it does not
The government’s position deserves to be stated fairly. A federal judge authorized the warrant, which requires a showing of probable cause. One current official described the search as part of a multiyear probe that includes whistleblower complaints. According to reporting by people familiar with the process, prosecutors first applied for the warrant more than a week before the search, and approval came only after discussion of constitutional issues such as the Speech or Debate Clause. No public official is above the law, and judicial authorization is not a trivial safeguard. NPRThe Boston........
