EDITORIAL: Discovery law changes will help ensure justice
Nobody, except criminals of course, want criminal charges dismissed over a “technicality.”
Having valid charges dropped — because a prosecutor failed to provide the defense with a document that has little bearing on the case, or having a case dismissed because defense attorneys waited until the clock for a speedy trial was almost up before seeking documentation to support their case — serves neither public safety nor justice.
As has often been the case in other criminal justice matters in New York such as bail reform and prison reform, the state went overboard with their changes, only to have to return later and fix the problems they created.
