A Saratoga County couple and their daughter involved in a plane crash on Great Sacandaga Lake two years ago are suing a local pilot for negligence.

Peter and Tami Cohan, along with their daughter Kylie Cohan, are suing Matthew Clemente, the owner of Clemente Motor, Inc., following a crash that occurred just before noon on Oct. 9, 2022, when Clemente attempted to take off from the Northampton Beach Campground on the Great Sacandaga Lake in Northville.

Clemente “failed to maintain control of the aircraft causing the aircraft to nose over, flip and crash,” according to the nine-page lawsuit filed last week in Saratoga County Supreme Court.

The Cohans were passengers aboard Clemente’s Maule MX-7-160 aircraft at the time of the crash.

“Matthew J. Clemente, breached said duty of care by failing to act as a responsibly prudent pilot or operator would under similar circumstances when he operated, controlled and maintained the aircraft so carelessly, negligently and recklessly,” the lawsuit reads.

Police at the time blamed the crash on a gust of heavy wind. One person was airlifted to a local hospital after officials from the state’s Department of Environmental Conservation picked up the passengers from the wreckage site by boat.

But the family suffered “severe and permanent injuries” to their head, body and limbs, and were “rendered sick, sore, lame and disabled and sustained severe shock” to their nervous system, according to the lawsuit.

“Many of said plaintiff’s injuries are reasonably certain to be permanent in nature,” the lawsuit reads.

The crash, according to the lawsuit, is the responsibility of Clemente and caused “solely by reason of the gross and/or ordinary negligence, carelessness, recklessness and culpable conduct” of the pilot, the lawsuit states.

The lawsuit claims neglect on the part of Clemente and is seeking judgement “for a sum greatly in excess of the jurisdiction of all lower courts” along with further relief the court deems just.

Clemente, a Rensselaer County native, could not be reached for comment.
