New Delhi: In India, it may be difficult for you to get an alcoholic drink without furnishing your Aadhaar card — if you are (or look) underage — but you can always watch porn online even if you are a pre-teen who has cursory knowledge of how to browse the internet. In fact, you have an entire à la carte menu to choose from! There are pure porn sites that are free for viewing which people are using virtual private networks (VPNs) to access. Then there are OTT platforms that work on the fly which charge a moderate fee from subscribers. But yes, if you want it. You can have it. Age NO BAR!

Pornography is a grey area when it comes to law and legalities. While there is a strict code of conduct governing various aspects of pornographic content being circulated in the boundaries of a country, they are usually laced with loopholes, and are easy to permeate without much ado. The same is the case in India and our affair with porn content, specifically with what is available online.

The recent Supreme Court of the US hearing (in January, 2025) which was hearing arguments on a Texas mandate of 2023 that questioned both the intent and the viability of having stricter age-restrictions imposed on porn content available online. The decree is expected in June 2025 but the judges appear to be sympathetic on strict rules online as well. It is pertinent to note here that the laws governing accessibility to pornographic content offline (like movie theatres or a magazine store) is safeguarded with multiple guardrails. So, why not have the same in place for content that is online? The Court may support this decision and bring out a law in the United States soon enough, should India follow........
