Johnson says Congress, administration will ‘determine the best path forward’ after SCOTUS tariff ruling

Speaker Mike Johnson (R-La.) said Congress and the White House will “determine the best path forward in the coming weeks” after the Supreme Court struck down the bulk of President Trump’s sweeping tariffs Friday in a rare rebuke.

“No one can deny that the President’s use of tariffs has brought in billions of dollars and created immense leverage for America’s trade strategy and for securing strong, reciprocal America-first trade agreements with countries that had been taking advantage of American workers for decades,” Johnson wrote on social platform X. “Congress and the Administration will determine the best path forward in the coming weeks.”

The Supreme Court justices rejected Trump’s expanded use of the International Emergency Economic Powers Act (IEEPA) in imposing tariffs on nearly every country. The 1970s-era law allows the president to “regulate” imports when necessary to respond to national emergencies that pose an “unusual and extraordinary” threat. Trump is the first president to attempt to invoke the IEEPA to impose tariffs in its nearly 50-year history.  

“We claim no special competence in matters of economics or foreign affairs,” Chief Justice John Roberts wrote in the majority opinion. “We claim only, as we must, the limited role assigned to us by Article III of the Constitution. Fulfilling that role, we hold that IEEPA does not authorize the President to impose tariffs.” 

A few GOP tariff skeptics celebrated the Supreme Court’s ruling. Rep. Don Bacon (R-Neb.), for instance, called the Supreme Court’s ruling “common-sense” and “straightforward,” arguing that Article 1 of the Constitution gives tariff authority to Congress. 

“I feel vindicated as I’ve been saying this for the last 12 months. In the future, Congress should defend its own authorities and not rely on the Supreme Court. Besides the Constitutional concerns I had on the Administration’s broad-based tariffs, I also do not think tariffs are smart economic policy. Broad-based tariffs are bad economics,” Bacon wrote on X.

Six House Republicans, including Bacon, had joined Democrats to pass a resolution that would repeal Trump’s tariffs on Canada just last week. 

“Today’s decision by the Supreme Court reaffirms Congress’s authority under Article I of the Constitution to levy tariffs and restores balance between the legislative and executive branches,” Rep. Dan Newhouse (R-Wash.), who also voted for that resolution, wrote on X.

“Tariffs can be effective in securing new trade deals when used in a targeted manner. I remain committed to working with President Trumps’ administration to secure trade deals that put American farmers, businesses, and consumers first,” he added. 

Trump held a snap press briefing Friday afternoon to rail against the ruling.
