Secretaries speaking to the Speaker
For decades Kashmir practised, and preached, democracy without an opposition. Elections were held and governments changed in limited ways, but organised opposition was missing. Power circulated among a few actors; dissent was absorbed or suppressed. It was a managed democracy.Just as that system seemed to settle, the architecture was dismantled in 2019. By 2024 a managed democracy had become a controlled and constrained one.
After August 2019 the Lieutenant Governor, appointed by the Union, became the centre of power, with a veto on every decision of the elected government and on any resolution of the legislature, even a unanimous one. That became clear when the Chief Secretary and the Law Secretary wrote to the Speaker asking him not to put the statehood resolution to a vote.
The episode is the cleanest illustration of the claim that civil servants are subverting an elected government. The law is more precise, and less comforting, than slogans allow.
The law is Article 239 of the Constitution (Administration of Union Territories), read with Article 239A (Legislatures and ministries for certain UTs) and the Jammu and Kashmir Reorganisation Act, 2019. That is what Article 239A does for Puducherry and, by the J&K Reorganisation Act, 2019 does for Jammu and Kashmir. The Assembly is real and elected. It can legislate on the State List except public order and police, and on applicable Concurrent List entries. It is not a state legislature. That is the text, not an insult to the House.
The same Act limits discussion. Section 46 lets the Assembly frame procedure, subject to the........
