Supreme Court won’t stop Brian Flores’ lawsuit against NFL from going to open court

The Supreme Court on Monday turned away the NFL’s bid to stop a coach’s racial discrimination lawsuit from proceeding in open court, a battle that revolves around Commissioner Roger Goodell’s power. 

Minnesota Vikings defensive coordinator Brian Flores, who is Black, sued the NFL and three of its franchises in 2022 over accusations of systemic racism in coaching searches. 

In a brief order, the justices declined to take up the NFL’s plea that league rules require the dispute go before an arbitrator, not a judge and jury in open court.  Justice Brett Kavanaugh dissented and would’ve taken up the case. 

At the center of the dispute is Goodell’s default authority to serve as the arbitrator. The U.S. Court of Appeals for the 2nd Circuit warned it creates “arbitration in name only” because he lacks independence as the NFL’s........
