Prenups are common. The way to make sure assets you purchase after marriage are separate property is to sign a marital property agreement, also known as a postnup.
Q: Both my wife and I have been married before. We each have our own biological children and we brought our own assets, including financial accounts, to our marriage. We agree that we want to keep all of our property separate, and we will leave our belongings to our biological children. In Texas, I understand that anything purchased while married is community property. We both bought new cars, and we want them to be owned as separate property. How do we ensure that items we purchase individually remain separate property?
A: Cars and other investments that you and your wife purchase during your marriage are not necessarily community property.
