When a spouse dies, credit card debt can get messy
Resolving credit card debt after the death of a spouse can be complicated in Texas.
Q: My husband recently died. He had some credit cards in his name only. Am I responsible for paying these cards? If not, how do I notify the credit card companies? Would I simply give them a copy of his death certificate? His death has taken a toll on me and my finances. Any help you can provide will be greatly appreciated.
A: Under Texas law, you are only responsible for the portions of his credit card debt which were incurred to purchase what are called “necessaries” of your marriage.
Necessaries are things like food, shelter, clothing, medical care and legal fees, and it does not matter whether it was you or your husband who needed those things. The charges are necessary if they were made........
