Options for gaining access to assets when there is no will.

Q: My stepbrother died several months ago. He had no will but did own mineral interests and a bank account, and he rented a post office box. I am trying to gain access to his bank account and PO box, but neither will grant me access unless I have been appointed to serve as independent administrator. He owns no other real estate. How can I easily and affordably accomplish this? He and I have no other living siblings.

A: There is no easy or affordable way available.

One key thing you didn’t mention is where the minerals are located. I will presume they are in Texas. Mineral interests are considered to be real estate (if he owned royalty interests, that would not be considered to be real estate), and that means you will not be able to use a Small Estate Affidavit.
